The USA is not alone in suffering a backlog in processing immigration requests. Recently the U.S. Citizenship and Immigration Services (USCIS) unveiled new measures that are designed to to reduce wait times, and optimise the process for those waiting employment authorisation. The changes also look at expanding processing for premium types of applications.

Reduced waiting times:

The USCIS is establishing an internal cycle goal focussed on timings which aims to be completed by September 2023. Within this goal staffing numbers will be increased and new technologies will be implemented

Expanding premium processing:

In the past, premium processing has only been available to petitioners filing a Petition for a Non-immigrant Worker, and to certain employment-based immigrant visa petitioners, Immigrant Petition for Alien Workers.
This rule expands the premium processing services, giving applicants the option to pay to have their applications expedited. Going live soon, the USCIS will follow a phased approach to implement premium processing for the following cases:

Form I-140, Immigrant Petition for Alien Workers:

  • EB-1 Multinational Executive or Manager
  • EB-2 Member of Professions Holding an Advanced Degree or Exceptional Ability seeking a National Interest Waiver (NIW)
  • I-539, Application to Extend/Change Non immigrant Status
  • I-765, Application for Employment Authorization
