Last month, the UK Home Office published a new set of right to work guidelines which takes effect from April 6, 2022. On or after this date, employers should follow this guidance in order to establish or retain a statutory excuse against a civil penalty.
From this date it will become mandatory for employers to complete right to work checks using the Home Office’s online right to work checking system for individuals holding a current Biometric Residence Permit, Biometric Residence Card, status under the EU Settlement Scheme, Frontier Worker Permit or an eVisa.
In addition to completing the online right to work check, the employer will also have to validate the individual’s identity on a video call or in person.
As a final point it is worth noting that the temporary COVID-19 adjusted right to work checks measures will remain in place until September 30, 2022.
